Cookware and related cookware parts:
 
Townecraft Southeast warrants its Chef's Ware® cookware and related cookware parts to be free from defects in material and workmanship. In the event that any part of your Chef's Ware cookware or related cookware parts fail during normal recommended use, TCS will repair or replace the item free of charge.
 
This warranty does not cover golden brown or bluish brown heat stains that may result from overheating your cookware or using high heat. White spots can occur due to the presence of minerals, such as salt, in food or water. Please refer to the Chef's Ware "Helpful Hints for a Happy Kitchen" instructions received with your cookware for the proper use and maintenance of your cookware.
 
This warranty does not cover damage caused​​ from misuse, abuse, alteration, or commercial use, nor does it cover accidental damage, except as described in the Hazard Replacement section below.
 
BlendMix ™:
TCS warrants its BlendMix ™ and carafe assembly to be free from defects in material and workmanship for seven (7) years from the date of purchase. All other components are warranted against defects in material and workmanship for one (1) year from the date of purchase. Changes in bottle color or appearance do not affect performance and are not covered by this warranty.
 
Shipping damage:
TCS will replace any covered products damaged in shipment free of charge if you notify TCS within (five) 5 days of receipt of the product, simply contact Customer Service. As a condition of replacement, TCS may request that you make the damaged product available for collection at TCS's expense.
 
​ Hazard replacement:
TCS agrees to repair or replace its products or any part thereof, at half (50%) of the then current retail price at the time it is accidentally lost, stolen, destroyed or damaged by fire, storm or earthquake or any other Act of God. Proof of loss must be submitted to TCS within 60 days of its occurrence.
 
Warranty commitments may vary by product. Please refer to your specific product warranty for additional or specific warranty information related to your product. If you need information or clarification about your product warranty, please contact Customer Service.
 
If warranty service is required, contact the Customer Service Department listed below for instructions. You can then return the product properly packaged and postage prepaid along with your proof of purchase, name, address, telephone number, and a description of the claimed defect. Any product, including any part or parts, which, upon examination by TCS and / or the manufacturer, is found to be defective will be repaired or replaced with a comparable product or part at no charge during the warranty period. You assume the risk of loss or damage to the products, and are responsible for shipping and handling costs, when products are shipped by you to us for warranty service and when repaired or replaced products are returned to you, regardless of whether this warranty is found to apply. The limited warranty period for any product repaired or replaced under this limited warranty will be the remainder of the original warranty. TCS reserves the exclusive right to deny warranty product replacements or repairs for product returns without proof of purchase.
 
EXCLUSIONS:
THIS WARRANTY DOES NOT APPLY TO DAMAGES CAUSED BY ACCIDENTS, MISUSE, ABUSE, COMMERCIAL USE, NEGLECT, HANDLING, ALTERATIONS, ORDINARY WEAR, DAMAGE IN TRANSPORTATION, DAMAGE DUE TO ENVIRONMENTAL OR NATURAL ELEMENTS, OR SERVICE BY UNAUTHORIZED PERSONNEL. KITCHEN UTENSILS THAT HAVE BEEN DAMAGED BY USE WITH EXCESSIVELY HIGH HEAT OR KITCHEN UTENSILS THAT ARE CHIPPING (THE EXCLUSION APPLIES ONLY TO STAINLESS STEEL PRODUCTS), STAINED, DISCOLORED, MARKED, SCRATCHED, DEFORMED, OR INDICATED IN USE AT THE RECOMMENDED BY THE MANUFACTURER, IT WILL NOT AFFECT PRODUCT PERFORMANCE AND IS NOT COVERED BY THIS WARRANTY. MORE INFORMATION ABOUT THE WARRANTY MAY BE OBTAINED FROM THE TCS CUSTOMER SERVICE DEPARTMENT.
 
THIS WARRANTY IS LIMITED TO THE ORIGINAL CONSUMER WITH PROOF OF PURCHASE AND IS NOT TRANSFERABLE. HOWEVER, TOWNECRAFT SOUTHEAST LLC CONSIDERS THAT THE INVESTMENT MADE IN ITS PRODUCTS ARE FAMILY INHERITANCES. THE WARRANTY WILL BE EXTENDED TO THE PERSON OR PERSONS TO WHOM THE PRODUCTS ARE LIABLE WITH PROOF OF ORIGINAL PURCHASE OR PROOF OF SUCH ACT OF LEGATION BY THE ORIGINAL PURCHASER.
 
IF THE PRODUCT WAS NOT PURCHASED NEW FROM AN AUTHORIZED DEALER OR REPRESENTATIVE OF TCS, THIS WARRANTY IS NULL AND INVALID. PRODUCTS PURCHASED VIA ELECTRONIC COMMERCE OR ONLINE, INCLUDING BUT NOT LIMITED TO EBAY, AMAZON AND CRAIGSLIST, ARE NOT COVERED BY THIS WARRANTY AND THE WARRANTY ON SUCH PRODUCTS IS NULL AND INVALID.
 
TCS AND / OR THE MANUFACTURER RESERVES THE RIGHT TO USE REFURBISHED, RECONDITIONED, REPAIRED OR REMANUFACTURED PRODUCTS OR COMPARABLE PARTS IN THE WARRANTY REPAIR OR REPLACEMENT PROCESS. SUCH PRODUCTS AND PARTS WILL BE COMPARABLE IN FUNCTION AND PERFORMANCE TO AN ORIGINAL PRODUCT OR PART AND GUARANTEED FOR THE REMAINDER OF THE ORIGINAL WARRANTY PERIOD.
 
​ LIMITATIONS:
THE SOLE AND EXCLUSIVE LIABILITY OF TCS UNDER THIS WARRANTY, AND THE CONSUMER'S SOLE EXCLUSIVE REMEDY, IS LIMITED TO REPAIR OR REPLACEMENT OF THE DEFECTIVE PRODUCT AT THE EXCLUSIVE OPTION OF TCS. TCS SHALL NOT BE LIABLE FOR ANY OTHER DAMAGES, INCLUDING, WITHOUT LIMITATION, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER DIRECT OR INDIRECT, ARISING FROM OR IN CONNECTION WITH PRODUCTS, THEIR USE OR PERFORMANCE. IN NO EVENT SHALL TCS LIABILITY EXCEED THE PURCHASE PRICE PAID BY THE CONSUMER FOR THE PRODUCTS IN QUESTION.
 
Any oral or written description of a product is for the sole purpose of identifying it and will not be construed as an express warranty. Any assistance TCS, or an authorized TCS dealer or representative, provides outside of the terms or limitations of this Limited Lifetime Warranty will not constitute a waiver of such terms or limitations nor will it extend or reactivate the warranty. The limitations of this warranty apply regardless of any failure to fulfill the essential purpose of limited resources. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
 
THIS WARRANTY IS EXPRESSLY GIVEN IN LIEU OF ALL OTHER EXPRESS WARRANTIES. THE DURATION OF ANY IMPLIED WARRANTIES (INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) RELATING TO THE PRODUCTS IS LIMITED TO THE PERIOD DESCRIBED ABOVE OR THE PERIOD USED FOR THE SPECIFIC PERIOD OF TIME TWO (2) YEARS FOR HEAT CONTROL OR CORD).
 
Some states / jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This Limited Lifetime Warranty gives you specific legal rights and you may also have other rights which vary from state to state or country to country.
 
This Limited Lifetime Warranty is effective June 30, 2020 and applies to all purchases after this date and supersedes all prior Warranty information and / or warranty language in printed materials or on TCS line.
 
Warranties provided for Products purchased prior to June 30, 2020 will be honored with proof of purchase.
